TERMS AND CONDITIONS OF SALE

  1. 1. Definitions

    • "Buyer" means any person or entity that purchases Products from the Seller.
    • "Seller" means AL RAWDATAIN water bottling company.
    • "Products" means the bottled water and related products sold by the Seller.
    • "Order" means any purchase order or other written or electronic communication from the Buyer to the Seller requesting Products.
    • "Agreement" means these Terms and Conditions of Sale, together with any Order placed by the Buyer.

    2. Acceptance

    • Any Order placed by the Buyer is subject to these Terms and Conditions of Sale, which are deemed accepted by the Buyer upon the Seller's acceptance of the Order.

    3. Pricing and Payment

    • Prices for Products are as stated on the Seller's website or in the Order. Prices are subject to change without notice.
    • Payment is due immediately upon the placement of the Order.
    • If payment is not made in full by the due date, the Seller may charge interest on the overdue amount at the legal rate in Kuwait.
    • The Buyer is responsible for all applicable taxes, duties, and fees.

    4. Delivery

    • The Seller will deliver the Products to the address specified by the Buyer in the Order.
    • Delivery times are estimates only and may be delayed due to circumstances beyond the Seller's control.
    • The Buyer is responsible for inspecting the Products upon delivery and for reporting any defects or shortages to the Seller within 24 hours.

    5. Title and Risk of Loss

    • Title to the Products passes to the Buyer upon delivery.
    • The risk of loss passes to the Buyer upon delivery.

    6. Warranty

    • The Seller warrants that the Products will be of merchantable quality and fit for their intended purpose.
    • This warranty does not cover Products that have been misused, abused, or modified.
    • The Seller's liability under this warranty is limited to the replacement or repair of defective Products.

    7. Returns and Exchanges

    • Returns and exchanges are accepted within 14 days of the delivery date.
    • Returned Products must be in their original condition, unopened, and unused.
    • The Buyer is responsible for the cost of return shipping.
    • The Seller reserves the right to refuse returns or exchanges if the Products are not in their original condition or if the return is not made within the specified time period.

    8. Limitation of Liability

    • In no event shall the Seller be liable for any indirect, incidental, special, or consequential damages, including, without limitation, lost profits, lost revenue, or loss of use, arising out of or in connection with this Agreement or the sale or use of the Products.  
    • The Seller's total liability under this Agreement shall not exceed the purchase price of the Products.
    • The Seller is not responsible for any damages or defects to the Products that result from the Buyer's failure to store the Products in optimum conditions.

    9. Governing Law and Jurisdiction

    • This Agreement shall be governed by and construed in accordance with the laws of Kuwait.  
    • Any dispute arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts of Kuwait.  

    10. Force Majeure

    • Neither party shall be liable for any delay or failure to perform its obligations under this Agreement due to causes beyond its reasonable control, such as acts of God, acts of war, or natural disasters.  

    11. Severability

    • If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.  

    12. Entire Agreement

    • This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
